These Terms and Conditions (“Terms”) govern your access to and use of the donation services, account features, communications, content, and related services offered under the USA Cancer Society brand (“USA Cancer Society,” “we,” “our,” or “us”).

Please read these Terms carefully before using our services, creating an account, submitting information, making a donation, signing up for communications, or otherwise interacting with USA Cancer Society.

By using our services, making a donation, creating an account, submitting information, or agreeing to receive communications from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use our services or submit information through them.

These Terms contain important provisions, including disclaimers, limitations of liability, an arbitration agreement, and a class action waiver. Please review them carefully.

1. About USA Cancer Society

USA Cancer Society is a charitable outreach and fundraising brand operated by a Florida nonprofit religious organization.

References to “USA Cancer Society,” “we,” “our,” or “us” in these Terms refer to the organization operating USA Cancer Society and acting under that name.

Our activities support charitable, outreach, and operational purposes.

2. Tax Treatment of Contributions

Donations made through USA Cancer Society are contributions to its operating organization. Tax deductibility depends on the receiving organization’s tax-exempt status and applicable law.

Donors are responsible for consulting their own tax advisors regarding the tax treatment, deductibility, documentation, and reporting of any contribution.

3. No Sale, Product, or Service

USA Cancer Society does not sell products or services through donations.

A donation is a voluntary contribution to support our charitable mission, outreach, and operations. Unless expressly stated otherwise in writing, no goods or services are provided in exchange for a donation.

A donation is not a purchase of merchandise, paid content, membership access, professional services, counseling services, financial services, medical services, legal services, or any other product or service.

4. Unrestricted Donations by Default

Unless USA Cancer Society expressly agrees in writing to accept a donor restriction, all donations are unrestricted contributions.

Unrestricted donations may be used to support our general charitable, outreach, and operational purposes, as determined by our leadership in its discretion and consistent with applicable law and our mission.

References to specific outreach efforts, campaigns, causes, needs, examples, or programs do not create a donor-restricted fund unless USA Cancer Society expressly agrees in writing to accept the donation as restricted.

We may allocate unrestricted donations where needed most, including charitable activities, outreach, programs, general operations, communications, donor support, technology, administrative expenses, fundraising expenses, legal and accounting expenses, personnel, facilities, and other exempt-purpose activities.

5. Restricted Donations

A restricted donation is a donation that USA Cancer Society expressly agrees in writing to accept for a specific purpose.

We reserve the right, subject to applicable law, to decline, refund, redirect, or seek modification of any donation restriction that we determine is inconsistent with our mission, impossible or impracticable to fulfill, unlawful, administratively burdensome, inconsistent with applicable requirements, or otherwise unsuitable.

If we accept a restricted donation, we will use reasonable efforts to apply the donation in a manner substantially consistent with the accepted restriction.

If a restricted purpose becomes impossible, impracticable, illegal, wasteful, or inconsistent with our mission or applicable law, we may seek donor consent, legal modification, a refund, or other appropriate action.

6. Donation Processing

All donation amounts are listed in U.S. dollars unless otherwise stated.

By submitting a donation, you represent and warrant that:

  • You are authorized to use the payment method submitted;

  • The payment information you provide is accurate and complete;

  • You authorize USA Cancer Society and its payment processors to charge the donation amount you select;

  • You understand that a donation is a voluntary contribution and not a purchase;

  • You understand that, unless expressly stated otherwise in writing, no goods or services are provided in exchange for your donation.

We may use third-party payment processors and donation platforms to process donations. These third parties may collect and process payment information according to their own terms and privacy policies.

We reserve the right to refuse, decline, reverse, or refund any donation at any time, including where a donation appears unauthorized, fraudulent, mistaken, duplicative, inconsistent with our mission, restricted in a manner we cannot accept, or otherwise problematic.

7. Recurring Donations

If you choose to make a recurring donation, you authorize USA Cancer Society and its payment processors to charge your selected payment method in the amount and at the frequency you select until canceled.

Recurring donations may be offered directly or through a third-party donation platform. We may support account-based recurring donation management, guest donation management, third-party portal management, email-based cancellation, or another reasonable method for recurring donation administration.

You may cancel future recurring donations by following the cancellation method provided at checkout, through your account if available, through the applicable donation platform if available, or by contacting us at:

Cancellation requests must be submitted at least 24 hours before the next scheduled charge. If a cancellation request is submitted fewer than 24 hours before the next scheduled charge, we may not be able to prevent that charge from processing, but we will use reasonable efforts to cancel future charges.

You are responsible for keeping your payment method and contact information current. If your payment method fails, expires, or is declined, we or our payment processor may contact you for updated payment information or may stop processing future recurring donations.

8. Refund Policy

Donations are generally non-refundable.

We may issue refunds in our discretion for duplicate transactions, erroneous transactions, unauthorized transactions, processing errors, or where otherwise required by law.

Please include your name, donation date, donation amount, email address used for the donation, and a description of the issue.

Subject to applicable law, we reserve the right to deny refund requests that are unsupported, untimely, abusive, fraudulent, inconsistent with these Terms, or otherwise inappropriate.

9. Donation Amounts, Campaigns, and Content

We may change suggested donation amounts, fundraising campaigns, program descriptions, content, communications, features, or service functionality at any time without notice.

We may modify, suspend, discontinue, or remove any donation feature, account feature, campaign, content, communication feature, or other portion of our services at any time.

We do not guarantee that any particular feature, donation platform, account system, campaign, communication method, or service will remain available.

10. Donation Receipts

We may provide donation confirmations, receipts, recurring donation notices, annual summaries, or other donation-related records electronically.

Where applicable, donation receipts may state that no goods or services were provided in exchange for the contribution.

You are responsible for retaining donation receipts and consulting your own tax advisor regarding substantiation and deductibility.

11. Privacy Policy

Your use of our services and submission of personal information are governed by our Privacy Policy.

By using our services, submitting information, creating an account, making a donation, or signing up for communications, you acknowledge that you have reviewed our Privacy Policy and understand how we may collect, use, disclose, and retain personal information.

12. Eligibility and User Representations

By using our services, creating an account, making a donation, or submitting information, you represent that:

  • You are at least 18 years old and have reached the age of majority in your jurisdiction;

  • You have legal capacity to agree to these Terms;

  • You will provide accurate and complete information;

  • You will not use our services for unlawful, fraudulent, abusive, or unauthorized purposes;

  • You will comply with all applicable laws.

Our online services are not directed to minors under 18. If you believe a minor has submitted information to us without appropriate consent, please contact us.

13. Accounts and Access

We may allow users to create accounts, manage recurring donations, view donation history, update payment information, manage communication preferences, or access other features.

We may also allow donations without account creation or use third-party platforms to provide account-related functionality.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree not to share your account credentials, impersonate another person, create an account using false information, or access another person’s account without authorization.

We may suspend, restrict, or terminate account access at any time if we believe you have violated these Terms, submitted false information, engaged in fraudulent or abusive activity, created risk for us or others, or used our services in a manner inconsistent with our mission or applicable law.

14. User Conduct

You agree not to use our services to:

  • Violate any law, regulation, or legal right of another person;

  • Submit false, misleading, fraudulent, or inaccurate information;

  • Impersonate any person or entity;

  • Interfere with the operation, security, or integrity of our services;

  • Attempt to gain unauthorized access to accounts, systems, data, or networks;

  • Upload, transmit, or distribute viruses, malware, malicious code, or harmful content;

  • Scrape, harvest, copy, or extract data without authorization;

  • Engage in spam, phishing, abuse, harassment, threats, or harmful conduct;

  • Promote unlawful activity;

  • Abuse donation, refund, cancellation, or chargeback processes;

  • Submit content that is defamatory, obscene, abusive, hateful, threatening, exploitative, infringing, deceptive, or otherwise objectionable;

  • Interfere with another person’s use of our services;

  • Act in a manner that harms USA Cancer Society, its donors, supporters, personnel, vendors, or others.

We reserve the right to investigate, restrict, suspend, or terminate access to our services or any feature if we believe these Terms have been violated.

15. Educational and Informational Content

Our content, communications, and materials may include educational, informational, fundraising, outreach, and program-related information.

Such content is provided for informational purposes only. It is not medical, legal, financial, tax, investment, mental-health, psychological, or other professional advice.

You should consult qualified professionals for medical, legal, financial, tax, mental-health, or other professional advice.

16. No Guaranteed Outcomes

We may provide charitable communications, educational resources, encouragement, outreach materials, and related content.

We do not guarantee any specific financial, medical, legal, personal, emotional, relational, employment, immigration, housing, debt, health, healing, protection, or other life outcome.

Donations, communications, use of our resources, or participation in our activities do not guarantee any particular result.

17. Communications; Email, SMS, Calls, and Electronic Notices

By providing your email address, phone number, or other contact information, you authorize USA Cancer Society and its service providers to contact you regarding donations, receipts, recurring donations, account matters, organizational updates, fundraising communications, newsletters, administrative notices, and other related communications, where permitted by law and your consent.

Communications may be sent by email, SMS/text message, phone call, prerecorded message, autodialed call, automated text, push notification, mail, or other reasonable communication methods, where permitted by law and your consent.

Message and data rates may apply. Message frequency may vary.

You may opt out of promotional emails by using the unsubscribe link included in the email.

You may opt out of SMS/text messages by replying STOP, END, CANCEL, UNSUBSCRIBE, or another supported opt-out keyword.

Even if you opt out of promotional communications, we may still send necessary transactional or administrative communications, including donation receipts, recurring donation notices, account notices, security notices, legal notices, and responses to your inquiries, as permitted by applicable law and consistent with your applicable communication preferences.

18. User Submissions, Testimonials, Stories, Comments, and Feedback

Our services or related communications may allow you to submit testimonials, stories, comments, feedback, questions, photos, videos, reviews, messages, or other content now or in the future (“User Submissions”).

By submitting User Submissions, you represent and warrant that:

  • You own or have the necessary rights to submit the content;

  • The content is accurate to the best of your knowledge;

  • The content does not violate the rights of any third party;

  • The content does not contain unlawful, defamatory, infringing, abusive, deceptive, or harmful material;

  • Your submission does not violate any confidentiality, privacy, publicity, intellectual property, or other legal rights.

By submitting User Submissions, you grant us a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, publish, display, distribute, edit, adapt, create derivative works from, and otherwise use the submission, in whole or in part, for charitable, outreach, fundraising, educational, promotional, administrative, and other organizational purposes, in any media or format now known or later developed.

You understand that User Submissions may be treated as non-confidential unless we expressly agree otherwise in writing.

We are not obligated to use, publish, maintain, return, or respond to any User Submission.

We may remove, edit, reject, or decline to use any User Submission at any time and for any reason.

19. Social Media and Third-Party Platforms

We may maintain pages, profiles, groups, advertisements, or communications on third-party platforms, including social media platforms.

Your interactions with third-party platforms are governed by the terms and privacy policies of those platforms. We do not control third-party platforms and are not responsible for their practices, policies, content, or security.

Comments, messages, reviews, or content submitted on third-party platforms may be visible to others depending on the platform settings and your privacy choices.

20. Third-Party Links, Tools, and Services

Our services and communications may contain links to third-party payment processors, donation platforms, social media pages, video platforms, embedded tools, plug-ins, or other services.

We do not control and are not responsible for third-party platforms, content, policies, practices, security, products, services, or transactions.

Your use of third-party services is at your own risk and may be governed by the third party’s own terms and privacy policy.

21. Intellectual Property

Our services and content, including text, graphics, logos, designs, images, photographs, videos, audio, messages, articles, software, code, layouts, icons, and other materials, are owned by our operating organization or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may access and use our services for personal, non-commercial, informational, and donation-related purposes.

You may not copy, reproduce, modify, distribute, publicly display, publicly perform, sell, license, exploit, scrape, frame, mirror, or create derivative works from our services or content without our prior written consent, except as permitted by law.

Nothing in these Terms grants you ownership of any intellectual property associated with USA Cancer Society.

22. Copyright Complaints / DMCA Notice

If you believe material provided through our services infringes your copyright, you may submit a notice to:

23. Disclaimer of Warranties

To the fullest extent permitted by law, our donation services, account features, content, communications, and related services are provided on an “as is” and “as available” basis.

We make no warranties or representations of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, security, or uninterrupted operation.

We do not warrant that our services will be error-free, secure, uninterrupted, current, complete, or free from viruses or harmful components.

We do not warrant or guarantee any specific outcome from donations, content, communications, use of our services, or participation in our activities.

24. Limitation of Liability

To the fullest extent permitted by law, our operating organization and its officers, directors, employees, volunteers, agents, representatives, contractors, service providers, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including loss of data, loss of goodwill, loss of opportunity, emotional distress, reputational harm, lost profits, or other intangible losses arising out of or related to your use of our services, donations, communications, content, account features, third-party services, or these Terms.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to these Terms, donations, communications, or related services will not exceed the greater of:

  • The amount you donated through USA Cancer Society in the three months before the claim arose; or

  • $100.

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, the limitation will apply to the fullest extent permitted by law.

25. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless our operating organization and its officers, directors, employees, volunteers, agents, representatives, contractors, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, expenses, demands, actions, or proceedings, including reasonable attorneys’ fees, arising out of or related to:

  • Your use of our services;

  • Your violation of these Terms;

  • Your violation of any law or third-party right;

  • Your User Submissions;

  • Your misuse of donation, refund, cancellation, chargeback, account, or communication features;

  • Any false, inaccurate, misleading, unlawful, or unauthorized information you submit.

26. Dispute Resolution; Mandatory Arbitration; Class Action Waiver

To the fullest extent permitted by law, you and we agree that any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, our services, donations, recurring donations, communications, privacy practices, User Submissions, or your relationship with USA Cancer Society will be resolved through final and binding arbitration on an individual basis, rather than in court, except as stated below.

This arbitration agreement is governed by the Federal Arbitration Act.

A. Individual Arbitration

You and we agree that disputes will be arbitrated only on an individual basis. You and we waive any right to bring or participate in a class action, class arbitration, collective action, representative action, private attorney general action, or consolidated proceeding.

The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.

B. Arbitration Location and Rules

Arbitration will be conducted in Pinellas County, Florida, unless the parties agree to remote/video arbitration or another location.

The arbitration will be administered by the American Arbitration Association or another mutually agreed arbitration provider under the applicable consumer or commercial arbitration rules, depending on the nature of the dispute.

C. Exceptions

Either party may bring an individual claim in small claims court if the claim qualifies.

We may seek injunctive or equitable relief in court for claims involving unauthorized access, misuse of our services, intellectual property infringement, fraud, security threats, or conduct that may cause irreparable harm.

Nothing in these Terms prevents either party from reporting concerns to a government agency or cooperating with a government investigation.

D. Opt-Out Right

You may opt out of this arbitration agreement by sending written notice within 30 days after you first become subject to these Terms.

Your opt-out notice must include your name, email address, mailing address, and a clear statement that you wish to opt out of arbitration under the USA Cancer Society Terms and Conditions.

Opting out of arbitration does not affect any other part of these Terms.

E. Jury Trial Waiver

To the fullest extent permitted by law, if any dispute proceeds in court rather than arbitration, you and we waive the right to a jury trial.

27. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent any dispute is not subject to arbitration, the parties agree that the exclusive venue for any lawsuit or court proceeding will be the state or federal courts located in or serving Pinellas County, Florida, including the United States District Court for the Middle District of Florida where federal jurisdiction exists.

You consent to personal jurisdiction and venue in those courts.

28. Changes to These Terms

We may update these Terms at any time.

Changes will be effective when published unless otherwise stated. The “Last Updated” date at the top of these Terms indicates when they were last revised.

Your continued use of our services, creation or maintenance of an account, submission of information, or making of donations after changes are published constitutes acceptance of the updated Terms.

29. Termination or Suspension

We may suspend, restrict, or terminate your access to account features, communications, donation features, or related services at any time and for any reason, including if we believe you have violated these Terms, submitted false information, engaged in fraudulent or abusive conduct, created legal or security risk, or acted inconsistently with our mission or applicable law.

The provisions of these Terms that by their nature should survive termination will survive, including provisions related to donations, disclaimers, limitation of liability, indemnification, arbitration, intellectual property, governing law, and User Submissions.

30. Electronic Communications

You agree that we may communicate with you electronically, including by email, SMS, account notice, notices through our services, or other electronic means.

You agree that electronic communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.

31. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms, in whole or in part, in connection with a reorganization, restructuring, transfer of operations, merger, consolidation, or similar organizational event.

32. No Waiver

No waiver by us of any term or condition will be deemed a further or continuing waiver of that term or any other term.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

33. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.

The remaining provisions will remain in full force and effect.

34. Entire Agreement

These Terms, together with our Privacy Policy, Donation Terms and Disclosures, and any other policies provided through our services or presented during the donation process, constitute the entire agreement between you and us regarding your use of our services, donations, accounts, communications, and related activities.

USA Cancer Society operates from the United States. Our services are intended primarily for users located in the United States.

We do not currently target donations from outside the United States, but we may do so in the future.
